DiscountedLabs - Terms of Service

Welcome to DiscountedLabs. We provide a direct-to-consumer platform for laboratory testing services (the "Service"). By creating an account, placing an order (including by telephone), or using our website, you signify your binding agreement to these Terms of Service ("Terms").

DiscountedLabs reserves the right to modify these Terms at any time. Any changes will be posted on this page and become effective immediately. We will notify you of significant changes via our email newsletter. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.

1. General Conditions of Use

  • Eligibility and Use by Minors: Our services are available to individuals of all ages. For users under the age of 18, a parent or legal guardian is required to sign a digital consent and release form during the checkout process.
  • Accuracy of Information: You confirm that all information you provide to DiscountedLabs during the registration and ordering process is true, accurate, and complete.
  • Intellectual Property and Lawful Use: You agree not to reproduce, copy, or redistribute any text, images, or website structure from this website. You further agree to use the website only for its intended purpose and in a lawful manner.
  • Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree not to share your password with any third party.

2. Disclaimer of Medical Advice

You acknowledge that DiscountedLabs provides testing services, not medical advice. Our services are not intended to diagnose, treat, cure, or prevent any disease. The service is provided at your request. We do not establish a traditional doctor-patient relationship and do not provide CPT codes, diagnosis codes, or other information for insurance reimbursement purposes. Lab test results can sometimes be inaccurate for reasons outside of our control.

3. Purchase, Refund, and Order Policies

  • Standard Refund Policy:
    • Refunds may be requested before you submit your specimen (blood or urine) to a Patient Service Center.
    • Approved refunds are issued at 75% of the original purchase price.
    • No refunds will be processed more than 21 days after the original payment date.
  • Promotional "Money-Back Guarantee" Refunds:
    • From time to time, we may offer promotions like a "90-day money-back guarantee." These promotions can be discontinued at any time.
    • To qualify for a refund under these specific promotions, all of the following conditions must be met:
      • You must be a first-time customer (determined by personal data, not just email).
      • The order must not include any STD or Sickle Cell tests.
      • Your test results must contain no "high," "low," "abnormal," "alert," or "critical" flags.
      • The order must have been placed on or after 4/28/2022, with the specimen collected within 90 days of the order date.
    • The refund amount is limited to the actual price paid after all discounts, credits, or points are applied.
    • To file a claim, you must open a support ticket at [email protected] with the subject "Money Back Guarantee" within 15 days of your results being posted. Include your order number.
  • Order and Requisition Validity:
    • While your order with us never expires, the laboratory requisition form is valid for 12 months (or 6 months in certain cases, please check your requisition).
    • We will reissue an expired requisition at no cost when you are ready to test. We ask that you only request a reissue when you are certain you will be visiting a lab soon to avoid waste.
    • We reserve the right to charge a $15 administrative fee for reissues in cases of policy abuse or unforeseen circumstances.
  • Order Changes: A $15 administration fee will be charged for any request to change an order after it has been processed.

4. Coupons, Credits, and Discounts

Discount coupon codes are offered as a courtesy. They are not redeemable for cash and cannot be applied to orders that use Gift Certificates or multi-pack credits purchased at a discount. All credits (including Gift and House Credit Certificates) are non-refundable and cannot be combined. Only one credit or coupon may be used per order.

5. Test Results Turnaround Time

Estimated turnaround times are based on information from our lab partners (e.g., Quest Diagnostics). These are estimates only, and DiscountedLabs cannot guarantee they will be met in all cases.

6. Geographic Restrictions

Due to state regulations, our services are not available to residents of New York, New Jersey, or Rhode Island. By using our service, you confirm you are not a resident of these states. We reserve the right to cancel any order from these states, less applicable fees.

7. SMS/Texting Terms

By opting into our mobile messaging service, you agree to receive recurring transactional and promotional SMS/text messages. Consent is not a condition of purchase. Message and data rates may apply. You may opt-out at any time by texting STOP. For help, text HELP or email [email protected].

8. Loyalty Points Program

  • Earning: Registered customers earn loyalty points on orders after payment is complete.
  • Redeeming: Points can be redeemed for discounts on future purchases. Points have no cash value.
  • Expiration: Points expire one year from the date they are earned.
  • Refunds: If an order is refunded, any points earned from that order will be deducted.
  • Changes: We reserve the right to modify or terminate the loyalty program at any time.

9. Subscription Service ("Subscribe & Save")

  • Service: Allows customers to purchase tests on a recurring basis (e.g., every 1, 3, 6, or 12 months) for a discount.
  • Discounts: Coupon and loyalty point discounts do not apply to already-discounted subscription items.
  • Cancellation: Changes or cancellations must be made at least 48 hours before the next billing date to avoid charges.
  • Abuse: We monitor for abuse, such as signing up for a subscription to get the discount and then immediately canceling. We reserve the right to revoke discounts, charge a penalty fee (the difference between the subscription and regular price), or take other actions in cases of abuse.

10. Home Blood Testing Kits

  • Refunds: Refunds are offered only for kits that are defective, damaged, or incorrect. You must contact [email protected] with photo evidence within 7 days of receipt to qualify.
  • Returns: We do not accept returns or exchanges for home testing kits, as they are considered medical equipment. Please dispose of any unwanted kits.
  • Cancellation: Orders can be canceled for a full refund up until the point the item has shipped.

11. HIV Testing Consent

By ordering an HIV test, you consent to the performance of the test and acknowledge that you understand its purpose, limitations (including false positives/negatives and the early post-exposure window), and that results will become part of your medical record and may be reportable to state health agencies as required by law.

12. Promotional Offers

  • "Free Checkups Giveaway": This promotion is for new customers only who access the offer via a specific marketing landing page. Limit one per customer. We reserve the right to verify eligibility and convert a free checkup to a paid one if a customer is found to be ineligible. Abuse of this promotion may result in order cancellation and account termination.
  • "Test for $1, Pay After Results" Promotion: This promotion allows eligible new customers to pay $1.00 upfront, with the remaining balance charged automatically when the first test results are available. This offer cannot be combined with others. The $1 payment is refunded as site credit only.
  • "-25% Off Follow-up Test" Promotion: This discount applies to one-time purchases (not subscriptions). Payment is required upfront. No refunds are available after 24 hours from purchase. This offer may not be combinable with other promotions.
